Advertising Legal Requirements For The Intent To Not Use Rollback Millage Rate & Why It's So Misleading
Georgia Law requires that a rollback millage rate must be computed that will produce the same total revenue on the current year’s digest that last year’s millage rate would have produced had no reassessments occurred.
If Bryan County Schools decides not to use the rollback millage rate, there a several requirements, by law, that must be met:
The school district must hold three public meetings to explain the decision and give people a chance to share their thoughts.
The district must put a restricted notice in the local newspaper.
The announcement or notice must include specific language, referring to the decision as a "tax increase" if Bryan County Schools does not use the proposed rollback millage rate.
Even though Bryan County Schools has not increased their millage rate, by law, it must be advertised as a tax increase.
The public hearings must be advertised at least one week in advance of the meeting date.
One of the meetings must be held between the hours of 6pm and 7pm.
